1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and CareerScout AI ("we", "us", "our") governing your access to and use of the CareerScout AI web application and related services.

By creating an account, accessing, or using CareerScout AI, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using CareerScout AI on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

CareerScout AI is a web application that provides AI-powered CV analysis and job matching services. The service:

• Analyzes your CV/resume to extract skills, experience, and qualifications
• Uses AI-powered analysis via the Google Gemini API
• Searches for relevant job opportunities based on your profile
• Aggregates job listings from third-party job boards (Adzuna)
• Provides personalized job recommendations based on your skills and preferences
• Allows you to search and filter jobs by location, industry, and other criteria

3. Pricing & Subscription Tiers

CareerScout AI offers the following service tiers:

CV Analysis Limits: CV analyses are counted when you upload and process a new resume. Viewing previously analyzed CVs does not count toward your limit.

Job Search Limits: Job searches are counted each time you initiate a new search query. Viewing previously saved results does not count toward your limit.

4. Payments & Billing

4.1 Payment Processor

All payments for CareerScout AI Pro and Lifetime subscriptions are processed by Lemon Squeezy, which acts as our Merchant of Record. This means:

• Lemon Squeezy handles all payment processing, billing, and refunds
• Lemon Squeezy is responsible for VAT/GST collection and compliance
• Your payment information is collected and stored by Lemon Squeezy, not by CareerScout AI
• Invoices and receipts are issued by Lemon Squeezy

4.2 Subscription Terms

Pro Plan (€19/month):

• Billing Cycle: Pro subscriptions are billed monthly
• Auto-Renewal: Subscriptions automatically renew on your billing date unless cancelled
• Usage Reset: Your monthly limits (3 CV analyses) reset on each billing date
• Unused Allocations: Unused CV analyses do not roll over to the next month

Lifetime Plan (€149 one-time):

• One-Time Payment: Pay once and receive lifetime access to all Pro features
• No Recurring Fees: No monthly or annual charges
• Lifetime Updates: Receive all future updates and improvements
• Early Access: Get early access to new features before general release

4.3 Cancellation

You may cancel your Pro subscription at any time through:

• Your Lemon Squeezy customer portal (link provided in your purchase email)
• Contacting us at support@careerscoutai.com

Upon cancellation, your Pro benefits continue until the end of the current billing period, after which your account reverts to the Free tier.

4.4 Refunds

Refund requests are handled by Lemon Squeezy according to their refund policy. Generally:

• Refunds may be available within 14 days of purchase for EU customers (statutory right)
• Refunds are at the discretion of Lemon Squeezy for other cases

5. License & Usage Rights

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use CareerScout AI through your web browser
• Upload and analyze your CV/resume using our AI-powered tools
• Search for and view job listings aggregated from third-party sources
• Use the service for personal job seeking and career development
• Access updates and improvements as they become available

This license does not include the right to:

• Modify, reverse engineer, or decompile the application (except as permitted by applicable law)
• Redistribute, sell, or sublicense access to the service
• Use the service for any unlawful purpose
• Share your account credentials with others
• Use the service for commercial recruitment or staffing purposes without authorization

6. Usage Restrictions

You agree not to use CareerScout AI to:

• Illegal Activities: Upload fraudulent CVs, misrepresent qualifications, or use the service for any illegal purposes
• Harmful Content: Upload or process content that is defamatory, obscene, hateful, or promotes violence
• Spam or Abuse: Send automated bulk requests, scrape data, or engage in activities that could overload our services
• Circumvent Security: Attempt to bypass, disable, or interfere with security features, usage limits, or access controls
• Share Credentials: Share your account with others or use multiple accounts to circumvent limits
• Data Harvesting: Systematically scrape or harvest job listings or user data from the platform
• Free Tier Abuse: Delete and re-register accounts to bypass free tier usage limits. We track email usage to prevent this abuse (see section below).

Fair Use: CareerScout AI is designed for individual job seekers. Excessive or automated usage that impacts service availability for others may result in temporary restrictions or account suspension.

7. Privacy & Data

Your privacy is important to us. Our handling of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

• We store your CV content securely in Google Firebase Firestore
• CV analysis is performed using Google Gemini AI
• We collect minimal account data (email, name) via Google Sign-In
• Job search queries are sent to Adzuna to retrieve listings
• We comply with the General Data Protection Regulation (GDPR)
• You can delete your account and all associated data at any time

8. Third-Party Services

CareerScout AI relies on third-party services to function:

8.1 Google Gemini API

CV analysis is powered by Google's Gemini AI model. Your use of CareerScout AI is also subject to Google Cloud's Terms of Service. We send your CV text to Google for AI processing to extract skills and qualifications.

8.2 Adzuna Job Search API

Job listings are retrieved from Adzuna's job search platform. We are not responsible for:

• The accuracy, completeness, or availability of job listings
• The hiring practices or decisions of employers listed on Adzuna
• Changes to Adzuna's API that may affect search results

8.3 Google Firebase

Our backend infrastructure uses Firebase for authentication, database storage, and hosting. Your data is protected by Google Cloud's security measures.

8.4 Lemon Squeezy

Payment processing (when available) is handled by Lemon Squeezy. Your purchase is subject to Lemon Squeezy's Terms of Service.

9. Intellectual Property

CareerScout AI, including its code, design, user interface, and documentation, is protected by copyright and other intellectual property laws. The CareerScout AI name, logo, and branding are our trademarks.

Your Content: You retain all rights to your CV, resume, and any content you upload. By using CareerScout AI, you grant us a limited license to process your CV solely for the purpose of providing the analysis and job matching service.

AI Analysis Results: The skills, experience, and qualifications extracted from your CV by our AI are provided for your use. We do not claim ownership of this analyzed data, which is derived from your content.

10. Disclaimer of Warranties

AS-IS Service: CareerScout AI is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

We specifically disclaim:

• Accuracy: While we strive for high-quality AI analysis, we do not guarantee that CV analysis will be error-free, complete, or suitable for any particular purpose
• Job Outcomes: We do not guarantee that using CareerScout AI will result in job interviews, offers, or employment
• Availability: Continuous, uninterrupted access to the service or job listings
• Job Listing Accuracy: The accuracy, completeness, or current availability of third-party job listings
• Security: That the service will be free from vulnerabilities or immune to cyber attacks

⚠️ Professional Use Warning: CareerScout AI's CV analysis should not be used as the sole basis for career decisions. We recommend reviewing AI-generated skill extractions for accuracy and consulting with career professionals when making significant career choices.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, data, use, goodwill, or other intangible losses
• We shall not be liable for any damages arising from your use or inability to use the service
• Our total liability for any claims arising from or relating to these Terms or CareerScout AI shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless CareerScout AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of CareerScout AI
• Your violation of these Terms
• Your violation of any rights of third parties
• Content you upload or submit through the service
• Any false or misleading information in your CV
• Your interactions with employers or job boards through our platform

13. Termination

By You

You may stop using CareerScout AI at any time by deleting your account through the application settings and cancelling any active subscription. This terminates your license under these Terms.

By Us

We may suspend or terminate your access to CareerScout AI at any time, for any reason, including:

• Violation of these Terms
• Conduct that we determine to be harmful to other users or our services
• Non-payment of subscription fees
• Fraudulent activity or misuse of the platform
• Discontinuation of the service

Upon termination, your license to use CareerScout AI immediately ends. Sections regarding intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last updated" date.

For material changes, we will provide notice through:

• Email notification (for registered users)
• A notification in the application
• An update to this Terms of Service page

Your continued use of CareerScout AI after changes take effect constitutes acceptance of the modified Terms.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of the country where the data controller is established.

For users in the European Economic Area (EEA):

• Nothing in these Terms affects your statutory rights as a consumer under EU law
• You may bring legal proceedings in the courts of your country of residence
• We are subject to the jurisdiction of the courts where we are established

Dispute Resolution: We encourage you to contact us first to resolve any disputes. Most issues can be resolved through informal discussion.
